TERMS AND CONDITIONS

Please take some time to read these terms and conditions.  We want you to feel comfortable, knowing you are receiving the right cleaning services for your home.  


These terms take effect from 1 January 2022, and form an agreement between Botanica Clean Pty Ltd ACN 656 248 690 (Botanica Clean, we, us) and the customer ordering our services (you).  By booking cleaning services with us after we provide you with these terms and conditions, or by clicking 'I accept' when registering as a new customer on our website (www.botanicaclean.com.au), you confirm that you accept these terms and conditions, and agree to comply with them.

  1. About Botanica Clean  

    1. We believe that the home is the foundation of your, and your family’s, health. For this reason, our services are performed using all natural cleaning products, made in-house by Botanica Clean.  Our products contain all natural ingredients, such as vinegar, which is a natural disinfectant. 

    2. If you are looking for a COVID deep clean, a commercial premises clean, cleaning of a hoarding situation or a bond clean, please let us know before booking, as this is probably not the right service for you. 

  2. Our Cleaning Services 

    1. We agree to provide you with in-home cleaning services in accordance with this agreement and any confirmed booking that you have with us (Cleaning Services).

    2. All of our Cleaning Services are charged on an hourly rate basis, and you will generally need to pay for the total hours you have booked in advance of the clean. The cleaning services that are able to be provided within the allocated time you have booked will vary depending on the size of your home.  As a guide, below is a high-level description of the three types of cleans we currently offer:  

      1. Regular clean: A regular clean is typically 3 hours in duration, and is usually booked on a weekly or fortnightly basis. A regular clean will include cleaning surfaces around the home (including kitchen and bathroom counters), dusting furniture, cleaning toilets, and vacuuming and mopping interior floors. It may also include additional cleaning services, if time permits, depending on the size of the home; 

      2. Once-off cleaning. A once-off clean is typically between 3 - 6 was hours in duration, and includes all of the same services as a regular clean.  We charge slightly more for a once-off clean, because there is typically more work involved for our cleaners in cleaning a home that does not have regular weekly or fortnightly cleans; and 

      3. Detailed seasonal cleaning. A detailed seasonal clean is typically 4 - 8 hours in duration, and is usually booked once every three months. It includes all of the same services as a regular clean, plus cleaning windows and a comprehensive bathroom and kitchen clean (including inside the oven and Microwave). It may also include additional cleaning services, if time permits, depending on the size of the home. 

    3. The services provided for each type of clean above will vary slightly, depending on the home, and the duration of time booked for the clean. The cleaner will use their best efforts to perform as many Cleaning Services as they can in the time you have booked. If there is a particular area of your home that you would like us to focus on, please let us know when making the booking. We will use our best efforts to accommodate your requests within the time provided. 

  3. Booking with Botanica Clean 

    1. To book Cleaning Services with us, you must complete the customer registration form on our website and provide us with certain information, such as your contact details, the address of your home, and your cleaning requirements and preferences.  

    2. You agree to ensure that all of the information you provide to us (whether on our website, or otherwise), is true, correct and submitted in good faith. You must not provide us with the address, contact details or payment details of a third party, unless you have that person's consent to do so. 

    3. All booking requests are subject to availability and we reserve the right to refuse booking requests for any reason.

    4. Once we have confirmed your booking in writing, we will provide your contact details to the allocated cleaner to arrange a mutually convenient time for the Cleaning Services to take place.  You acknowledge that our cleaners will contact you from their own personal mobile phone and you agree to:

      1. not contact our cleaners for any purpose other than arranging times for scheduled cleans; and

      2. always communicate with our cleaners in a professional and courteous manner, respect each cleaner's privacy and only call or text our cleaners on their personal mobile phones during normal business hours. 

    5. We like to provide our cleaners with shifts of at least three hours, and in some cases, for casual cleaners, we may be required by law to do so. For this reason, we ask that you book a clean of at least three hours. If you would like a shorter clean, please let us know and we will use our best efforts to accommodate your request.  

  4. Cleaning products and equipment

    1. Using our own natural cleaning products is important to us, and the safety of our cleaners. For this reason, we do not allow our cleaners to use other cleaning products when performing the Cleaning Services. 

    2. If you would like the Cleaning Services to be performed using your own mop or vacuum, please let us know. We would be happy to use your preferred cleaning equipment, provided the equipment is safe, easily accessible to the cleaner, and in good working order. 

    3. If you ask us to use your own cleaning equipment (mop or vacuum):  

      1. we are not liable for any damage or wear and tear to that equipment; and

      2. we are not liable for, and will not give you a refund of any portion of the cleaning fees, if we are unable to perform the Cleaning Services properly because the equipment you provided is not safe, accessible or in good working order.

  5. Pricing and payment terms 

    1. Our Cleaning Services are charged on an hourly rate basis. The applicable hourly rates for each type of clean are published on our website (www.botanicaclean.com.au).  

    2. Unless we have agreed a different arrangement with you in writing prior to the scheduled date of your clean, you must pay for the Cleaning Services you book in full:

      1. in advance of the scheduled clean, by bank transfer or credit card; or

      2. within 7 days of receiving a tax invoice from us. 

    3. If you are not going to be home at the time of your scheduled clean, you must let us know and arrange payment in advance of your scheduled clean. We reserve the right not to perform the Cleaning Services if you have not paid for the clean in advance and are not home to make payment when the cleaner arrives.  

    4. If you have paid in advance for a clean, and we are unable or unwilling to perform the Cleaning Services for any reason, we will provide you with a full refund. 

    5. All prices quoted, unless otherwise specified, are inclusive of GST. Tax invoices are available, upon request.

  6. Our responsibilities 

    1. We agree to:

      1. provide the Cleaning Services in a professional manner with due care and skill, and at the agreed time and location; and

      2. ensure all of our cleaners involved in providing you with the Cleaning Services are appropriately trained and equipped with all necessary cleaning products and equipment. 

  7. Your responsibilities

    1. You must: 

      1. treat our clearers with respect at all times and not engage in any conduct that could make our cleaners feel uncomfortable or unsafe;   

      2. provide us with all of the information that we reasonably need in order to provide you with the Cleaning Services in a safe and efficient manner, including, for example:

        1. if someone other than you will be at the home to make payment and let the cleaner in; and

        2. if there will be any pets present at the time of the clean; 

      3. provide our cleaners with a safe working environment, and sufficient access to your home and utilities (including hot and cold water, electricity, and rubbish bins) to enable the cleaner to perform the Cleaning Services;  

      4. not leave obstructions in the areas of your home that require Cleaning Services, or ask our cleaners to move or dispose of any furniture, heavy items or hazardous materials; and 

      5. securely stow away any important documents, antiques, valuables or fragile items for the duration of the Cleaning Services. 

    2. We are not liable to you for any delays, damage or loss you suffer as a result of your failure to comply with the above responsibilities and you agree to indemnify us in relation to any loss or damage that we suffer (including third party claims against us) that arise as a result of your failure to comply with clause 7.1.

    3. We recommend that you are always present when our cleaners are providing Cleaning Services at your home.

    4. If you choose to lend a cleaner a key to your home because you will not be present at the time of a scheduled clean, you do so at your own risk. Botanica Clean is not responsible for the cost of replacing lost or damaged keys. 

    5. It is your responsibility to maintain adequate insurance for your home. 

  8. Cancellation and no access fees 

    1. If you need to cancel or change your booking, please provide us with as much notice as possible so that we can make alternative arrangements for our cleaners.

    2. If you cancel less than 24 hours in advance of a scheduled clean, or if our cleaner arrives at your home at the scheduled time is unable to access the home, we reserve the right to charge you an administrative fee of $100 (including GST), which you must pay within 7 days of receiving an invoice from us.  

  9. COVID-19 vaccination policy 

    1. We do not currently have a mandatory vaccination policy at Botanica Clean and accordingly, some of our cleaners may be unvaccinated against COVID-19.   

    2. If you would like to request that only cleaners that are fully vaccinated against COVID-19 attend your home, you must notify us when you make your booking.  

    3. Please do not ask our cleaners for information concerning their vaccination status (or any other personal information). If you have any questions or concerns regarding our Cleaning Services or cleaners, please contact Botanica Clean on (07) 2139 3770 or bookings@botanicaclean.com.au

  10. Confidentiality and privacy  

    1. We agree to keep the information you provide to us concerning your home and cleaning needs confidential. We will only use this information for the purposes of providing you with services, or performing our obligations and exercising our rights under this agreement.   

    2. You agree to keep the information we provide to you concerning our cleaners confidential, and not to use or disclose the information for any purpose other than performing your obligations and exercising your rights under this agreement. 

  11. Complaints

    1. If you are dissatisfied with the Cleaning Services provided, please let us know within 24 hours of completion of the Cleaning Services by contacting us by email on bookings@botanicaclean.com.au.

    2. We take all complaints seriously and will respond to you promptly. 

  12. Suspension and termination 

    1. You may notify us at any time that you no longer wish to purchase Cleaning Services from us. Note, however, that we may charge an administrative fee in accordance with clause 8, if a scheduled clean is cancelled with less than 24 hours' notice. 

    2. We may terminate this agreement, or suspend the provision of Cleaning Services to you, at any time by providing you with notice in writing. If we cancel a booking that you have paid for in advance, we will provide you with a full refund for that booking. 

  13. Liability 

    1. We exclude, to the fullest extent permitted by law, all warranties, representations and conditions whether implied by law, trade, custom or otherwise.

    2. If the Australian Consumer Law applies to the Cleaning Services, our liability to you for any loss that you suffer or incur relating to our failure to comply with any consumer guarantee set out in the Australian Consumer Law is limited to (at our election):

      1. the re-supply of the services; or 

      2. the payment of the cost of having the services supplied again. 

    3. The liability of Botanica Clean for any loss or damage, howsoever arising (including negligence) suffered by you in connection with this agreement is limited to an amount equal to the price you paid to us for the relevant Cleaning Services, or $100 (whichever is greater). This clauses 13.3 does not apply to the extent that it would cause us to contravene a law or cause the clause to be void or unenforceable.

  14. No engagement of cleaners

    1. We have invested significant time, effort and resources in recruiting and training our cleaners. For this reason, retaining our cleaners is important to us. You must not, during the period we are engaged to provide Cleaning Services for you and for 6 months after our last Cleaning Service for you, directly or indirectly engage, employ, solicit or otherwise retain any person who is an employee or subcontractor of Botanica Clean. 

    2. Breaches of this clause may result in Botanica Clean suffering financial loss, including costs associates with the recruitment and training of replacement cleaners. You agree that the restrictions in this clause 14 are necessary to protect the legitimate interests of Botanica Clean. 

  15. Changes to these terms and conditions 

    1. Botanica Clean reserves the right to update or modify these terms and conditions from time to time. We will publish the updated terms and conditions on our website, with the effective date of the update shown. Please check our website regularly to keep abreast of any changes. 

  16. Severability

    1. You agree that is any part of this agreement is held invalid, void or unenforceable, then that part will be considered severable and the remaining terms of in this agreement shall continue to be binding.

  17. Law and jurisdiction

    1. This agreement shall be governed by the laws of Queensland.  Each party submits to the non-exclusive jurisdiction of the courts of Queensland in the event of any dispute.
